Shift is a mobile app and website (together, the “Service”) owned and operated by YAVANNA PTE. LTD. (“YAVANNA”, “we”, “us”, “our”), a company incorporated in Singapore (UEN: [Company Registration No.]). These Terms of Service (“Terms”) govern your access to and use of the Service. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Shift helps you log sustainable actions, view your environmental impact, and earn points that may be redeemable for rewards with participating partner merchants. We may add, change, or remove features at any time.
2. Your account
You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You are responsible for activity that occurs under your account.
3. Acceptable use
- Do not submit false, misleading, or fraudulent action logs or photos.
- Do not attempt to manipulate points, rewards, referrals, or the approval process.
- Do not interfere with, disrupt, or attempt to gain unauthorised access to the Service or its systems.
- Do not use the Service in violation of any applicable law.
4. Points and rewards
Points have no monetary value, are not transferable, and cannot be exchanged for cash. Reward availability is determined by us and our partner merchants and may change or be withdrawn at any time. We may adjust or revoke points obtained through error, fraud, or violation of these Terms.
5. Intellectual property
The Service, including its software, design, and content, is owned by YAVANNA PTE. LTD. or its licensors and is protected by applicable laws. You retain ownership of content you submit (such as photos), and grant us a licence to use it solely to operate and provide the Service.
6. Third-party services
The Service relies on third-party providers and may link to partner merchants. We are not responsible for the content, products, or practices of third parties.
7. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Impact metrics are estimates provided for informational and motivational purposes and may not be exact.
8. Limitation of liability
To the maximum extent permitted by law, YAVANNA PTE. LTD. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms. You may stop using the Service and delete your account at any time.
10. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Singapore. You agree to submit to the exclusive jurisdiction of the courts of Singapore in respect of any dispute arising out of or in connection with these Terms or the Service.
11. Third-party rights
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of these Terms.
12. Severability and entire agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and YAVANNA regarding the Service.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance.
